The Consumer Credit Act 1974 is a piece of legislation that provides consumers with a wide variety of rights against lenders – and it has been ignored for much of the past 36 years.
If lenders fail to follow the strict requirements of the Consumer Credit Act, an agreement between a lender and a consumer may be unenforceable.
This can see debts being written off, credit files expunged and legal costs met by the lenders – a happy outcome at a time of economic difficulties.
Griffin Law, working closely with the country’s leading Consumer Credit Act barristers in London, acts for consumers who wish to exercise their rights and who want to challenge the enforceability of
- Personal loans;
- Credit cards;
- Student loans;
- Hire purchase agreements; and
- Payment protection insurance policies.
Better still, if the unreasonable conduct of a lender results in an “unfair relationship” arising, lenders can sometimes be ordered to repay money to consumers. For that reason lenders are keen to settle claims rather than to face the wrath of the courts.
Griffin Law, as acknowledged experts in this field, are pleased to act for consumers under a conditional fee agreement – commonly known as a “no win, no fee agreement”. As the name suggests, this means that if our clients are not successful, we don’t get paid. If we win, the lender pays our fees.
As a leading firm of Consumer Credit Act lawyers, Griffin Law has also negotiated a highly favourable deal with a leading firm of insurers, so as to protect our clients from the risk of being ordered to pay the lenders’ costs if a case is unsuccessful. This after-the-event insurance policy is a unique product available only to Griffin Law clients.
After the havoc caused on our economy by the banks, it is only right that they are held to account by those who borrowed from them.
Wouldn’t you like the scales of justice tilted in your favour for once?

“Nothing is inevitable in life except death and taxes”.
Have you ever received substandard service from a lawyer, accountant, surveyor, architect, doctor or other professional?
Ordinarily when a crime occurs, the prosecution is brought by the Crown after a police investigation. Sometimes, however, the police or the Crown Prosecution Service fail to proceed – and this can leave a victim feeling aggrieved and in those circumstances it can often be appropriate to bring a private prosecution.
The past decade has seen an explosion in claims brought arising out personal injuries and clinical negligence.
“Tax doesn’t have to be taxing” – so says HM Revenue & Customs. And yet all of us know that dealing with the tax authorities is anything but straightforward – and it is only going to get worse as taxes rise in the coming years.
Litigation is at the heart of Griffin Law’s work for its clients. The firm’s team has handled cases at all levels of the judicial system, as well as in various other jurisdictions ranging from the Isle of Man to the British Virgin Islands.
Of all the disputes that arise, often the most contentious are between landlords and tenants – which is hardly surprising given that a landlord’s investment property may be his principal investment asset and that property is the tenant’s home.
Judicial review, often referred to as public law or administrative law, is a specialist area of practice requiring more than mere knowledge of the law. Given the constitutional implications of each and every judicial review decision, a sound working knowledge of the fusion between constitutional politics and the law is essential – a working knowledge that Griffin Law has.
Insurance is a fact of life. All of us take out a myriad of insurance policies ranging from health insurance to pet insurance, car insurance to contents insurance, buildings insurance to life insurance. The majority of the time, insurers do what they promise to do. They meet customers’ claims and those customers receive everything they expected to receive.
Working with a team of experienced barristers, enquiry agents, trustees and lawyers, Griffin Law has the expertise to help deal with all areas of family law including divorce and separation, co-habitation and paternity disputes and issues relating to children.
With unemployment set to continue to rise for months, if not years, it is absolutely essential for employees to know their rights.
Power matters. Griffin Law has particular expertise in giving advice on election law, having acted for voters, candidates and agents in local, parliamentary and European elections.
Libel, slander and malicious falsehood – once seen as the concern of the mighty are increasingly causes for concern for more and more people.
Buying or selling a home, or indeed tapping into equity in that home, can often be a stressful business. It need not be so.
In the current economic climate, everyone is finding things difficult. Some individuals – including those who might be thought of as being wealthy – have discovered that their finances are such in a mess that drastic measures are called for.
